1. The defendant received on January 19, 1984 the Changwon District Court received on January 19, 1984 as to the real estate stated in the attached list from the plaintiff.

1. The description of the grounds for the claim shall be as specified in the attached Form;

2. Articles 208 (3) 2 and 150 (3) of the Civil Procedure Act of the applicable provisions of Acts (a judgment on whether to be deemed as a foreigner);

Where a provisional registration has been made to preserve the right to claim ownership transfer registration under a sales contract for the reason of judgment, the right to claim the principal registration based on the provisional registration against the person who has established the provisional registration shall not extinguish the right to claim the principal registration based on the provisional registration pursuant to the principle of confusion on the ground that the person having the right to claim the provisional registration has received a separate ownership transfer registration from the person having established the provisional registration (Supreme Court Decision 2004Da59546 Decided February 22, 2007). However, even if a person having the right to claim the provisional registration has received a separate ownership transfer registration, if the restriction on disposal in the third party on the object of the provisional registration is not registered or the interim disposition is not registered after the provisional registration has been completed, and the reason for the provisional registration and the ownership transfer registration are also the same in substance, the obligation

Therefore, the right to claim ownership transfer registration to be preserved by provisional registration should be considered to be extinguished.

Ultimately, since the provisional registration of this case should be cancelled, it is so decided as per Disposition by accepting the plaintiff's claim.
