Purport of claim and appeal

1. The following facts may be found either in dispute between the parties or in full view of the respective entries in Gap evidence 1 and 16 (including paper numbers; hereinafter the same shall apply) and the whole purport of the pleadings:

On June 20, 2013, the Plaintiff was awarded a contract for the construction of a new factory to the Seongbuk-gu Seongbuk-gu Seongbuk-gu, Seongbuk-gu, Seongbuk-gu, Seongbuk-gu, Seoul. On October 18, 2013, the Plaintiff subcontracted the above factory construction to the Defendant for construction cost of KRW 792,00,000,000.

B. On May 30, 2014, the Defendant completed the instant construction work.

2. Determination

A. The summary of the Plaintiff’s assertion was that the Defendant used defective materials while performing construction of the tent Panel during the instant construction, and caused the scenic view, durability, and water leakage defects in the tent by faithfully constructing a bnick, roof rainwater, and line home gate.

Therefore, the defendant should pay 14,268,605 won as compensation for damages in lieu of defect repair to the plaintiff.

In addition, the plaintiff paid KRW 800,000 to investigate the causes of water leakage and KRW 894,150 to investigate the causes of defects in water leakage field. The defendant should pay the plaintiff totaling KRW 1,694,150 to the plaintiff.

B. Comprehensively taking account of the respective descriptions and arguments in Gap's evidence Nos. 2, 4, 15, and 16 arising from the instant construction project, the defendant stated that he/she would actively cooperate with the plaintiff on January 7, 2014 with respect to the resolution of problems caused by defective materials, such as the wab phenomenon, etc. in the part of the Incheon District Panel. On January 13, 2014, the defendant expressed his/her intention to be responsible for and repair through consultation with the plaintiff on January 13, 2014. On March 18, 2014, the defendant filed a lawsuit against Suwon District Court 2014Gahap3910 against Suwon District Court and the Panel Co., Ltd. to compensate the defendant for damages caused by defective materials supplied by the said company.
