A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

1. No person shall photograph the body of a person who may cause a sexual humiliation or sense of shame, using a camera or any other device similar thereto, against the will of the person subject to shooting;

그럼에도 불구하고 피고인은 2018년 7월 초순경 군산시 B에 있는 1층 주택 화장실에서 성명불상의 여성인 피해자가 나체인 상태로 목욕을 하는 것을 발견하고, 동영상 기능을 켠 휴대전화를 손에 들고 손을 위로 뻗어 위 화장실의 열린 창문 사이로 피해자의 가슴, 음부 등을 약 20초간 촬영하였다.

Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame by using a camera, against the victim's will.

2. No one shall distribute, sell, lease, provide, openly exhibit, or screen photographs or reproductions taken by a person subject to filming against his/her will, and distribute, sell, lease, or openly display any obscene codes, letters, sound, images, or motion pictures through an information and communications network;

Nevertheless, at around 01:31 on July 6, 2018, the Defendant, at the Defendant’s house located in Sinsan-si, made up a notice in the title “D”, “E” on the bulletin board, which is an Internet obscene material site, and opened up a photograph of the screen image taken against the victim’s will, as in the foregoing paragraph (1), from that time, up to October 16, 2018, the Defendant displayed the photograph of the screen image up to six times in total as shown in the attached Table “crime Day” and displayed the screen pictures up to the victim’s intent openly and simultaneously displayed the obscene image up to six times in total.
