피고인은 2016. 7. 3. 16:30경 서울 강서구 B에 있는 피해자 C(여, 45세)가 운영하는 ‘D’ 식당에서 술에 취하여 주문한 꼼장어에 간이 나오지 않았다는 이유로 환불을 요구하면서 피해자에게 “이 씨발년아 돈 줘, 너 이 자리에서 장사할 수 있나 보자”라고 소리를 지르고, 옆에 있는 성명불상 손님들에게도 “씨발놈들아”라고 욕설하여 손님 여러 명을 나가게 하는 등 행패를 부려 약 2시간 30분 동안 위력으로 피해자의 식당 영업 업무를 방해하였다.
