1. Defendant A shall be punished by imprisonment with prison labor for eight months: Provided, That the above sentence shall be executed for two years from the date this judgment becomes final and conclusive;

Punishment of the crime

1. On February 26, 2014, Defendant A filed a lawsuit seeking revocation of the return of an application for building permit against the head of Young-gun, who was subject to a disposition of return of the application for building permit from the number of Young-gun, the total area of 15,629 square meters of the remaining Young-gun and six parcels of land from the number of Young-gun residents residing in Young-gun, Nam-gun, Nam-gun, and the total area of 15,629 square meters in total. On October 16, 2014, Defendant A received a favorable decision from the Gwangju District Court that the rejection of the application for building permit was revoked on or around October 5, 2014.

② On December 31, 2014, Defendant A agreed to sell the instant real estate to the victim (a seller: the representative director of the agricultural company (A), the victim’s female P, and the hereinafter “the instant sales contract”) with the victim D (a frequent civil petition by malodor and dust generation among local residents). ③ Defendant A and the victim agreed to sell the instant land to the victim with the F, G, H, I, J, J, K, L, M, N (a total of 14,723 square meters) (hereinafter “the instant real estate”) (a seller: the representative director of the agricultural company (A), the victim’s female P, and the hereinafter “the instant sales contract”). At the same time, Defendant A and the victim prepared a separate agreement on the instant land purchase and sale contract for the purpose of the instant land use with Qu group (hereinafter “the instant land purchase agreement”) by no later than 15 months prior to the conclusion of the agreement on the purchase and sale of the instant land with Qu group (hereinafter “the instant land purchase agreement”).
