1. Facts of recognition;

A. On July 3, 2018, the Plaintiff received mobile phone text messages that recommended loans and received the phone number in order to obtain the loan. Meanwhile, the Defendant received mobile phone text messages, which recommended loans on June 25, 2018, and sent the money directly to the Defendant’s FF Bank account and to the person who notified the said name holder of the fact-finding, on July 3, 2018, the Defendant heard that “If she wishes to obtain loans, he/she would withdraw and return the money transferred to the account in the Defendant’s name because there is any specification of transactions in the account in the Defendant’s name, he/she would use the money in repayment of the Defendant’s existing loan.”

C. On July 6, 2018, the Plaintiff knew that he/she remitted the said money to a loan fraud crime, and reported the fact of damage to the head of Yang Nam-nam Police Station.
