Reasons
Punishment of the crime
[criminal record] On July 26, 2018, Defendant B was sentenced to six months of imprisonment for fraud, etc. at the Seoul Central District Court and one year of suspended execution, and the judgment became final and conclusive on August 3, 2018.
[2] The Defendants, even if they received KRW 100 million from the victim C, are able to use the money as a “money laundering” so that they may use the money as a “money laundering” and, notwithstanding the fact that there is no intent or ability to reduce the amount of money as a price, they would have to receive the profits of KRW 100 million from the “money laundering.”
There was a public contest with D to acquire money by means of fraud.
Accordingly, D calls from the victim on June 2017 to the victim on the Haman Sck's land in order to pay the proceeds of KRW 300 million from KRW 300,000 to KRW 50,000,000 if it invests 100,000,000,000,000,000 won.

At around 12:00 on June 29, 2017, Defendants and D continued to talk with the victim at the mutual infinite coffee shop near the Gangnam-gu Seoul Yungdong-dong, Gangnam-gu, Seoul. The above Defendant sought a passbook of 5 billion won in the balance necessary for the money laundering from the victim, and thereby means that the victim “a certain business receiving KRW 1 billion as a reward after launding the money from the money laundering is invested,” and the Defendants were issued a letter of 100 million won in the face value to the victim’s own face value as an investment money from the victim’s side to the same purport.
As a result, the Defendants conspired with the above D by deceiving the victim and by deceiving the property.
