"2015 Highest 839": Defendant A, D, and E

1. After purchasing a new vehicle through an installment contract, Defendants A and D conspired to obtain a loan from the borrower as a security, and explain all the above circumstances to Defendant D-friendly E, and requested Defendant D to lend only the name of the loan since they are held responsible. On January 14, 2014, the Hyundai Capital Co., Ltd., Ltd., Ltd., Ltd., which is linked to Jeju, made E to purchase a new vehicle to its members and operate it normally and make a false statement as if the installment payment would be paid normally. The Defendants concluded a new installment contract between Hyundai Capital Co., Ltd., Ltd., Ltd., with the installment period of 60 months to be set between Hyundai Capital Co., Ltd., Ltd., and the principal of the loan amount of 34 million won.

However, in fact, the Defendants did not have the intent or ability to normally operate a vehicle or pay installment payments in the name of E, on the ground that they were released from a new vehicle without the intention of possession after purchasing the new vehicle, provided it as a collateral and intended to obtain a loan from the borrower.

The Defendants, by deceiving the above F, had the victim Hyundai Capital Co., Ltd. pay KRW 34 million as an installment financing loan to a motor vehicle by deceiving the victim, and acquired the same amount of financial benefits from the automatic car delivery.

1. On July 2013, the Defendant, against the victim G, would allow the victim G to participate in the said game business in an influorous place not exceeding Seoul Shoman.

If a person lends his/her name in order to buy a heavy loan with a modern capital loan, he/she will pay all of the loans with a game business within two months and transfer his/her name to another person.
