A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 29, 2017, from around 23:50 to April 09:00 on April 30, 2017, the Defendant, “E” located in Seocho-gu Seoul Metropolitan Government D, created KRW 100,000 by printing the image file of merchandise coupons on the paper (A) No. 100,000 won, using the Nowon-gu and Samsung C, for the purpose of committing fraud from around 23:50 to April 30, 2017.

On May 1, 2017, the Defendant sold 100,000 won merchandise coupons to “100,000 won and KRW 20,60,000,000 on the Internet site” using Nompt 905 of the above hotel, which is an Internet site.

On May 1, 2017, at around 15:40 on May 1, 2017, a false statement was made to the effect that “A victim F, who reported and contacted the above writing in front of the entrance No. 4 located underground 294 at the beginning of Seocho-gu Seoul, shall be sold to the victim KRW 100,000,000, and KRW 20,000,000,000,000 won.”

However, in fact, even if the defendant receives the sales price from the injured party, the defendant only thought that 20 gift certificates were prepared as above to the injured party, and there was no intention to dry gift certificates.

around 15:40 on May 1, 2017, the Defendant: (a) transferred KRW 9.30,000 in the name of the sales proceeds of merchandise coupons to the Defendant’s account in the name of the Defendant; and (b) 20 merchandise coupons were generated by the Defendant, as above, to the victim.

In addition, from April 22, 2017 to around that time, the Defendant received a total of KRW 2,388,000 from 11 victims to the account under the name of the Defendant, as shown in the list of crimes in attached Table 12 times.

Accordingly, the defendant was informed of the victims to receive property.

On April 23, 2017, the Defendant posted a notice on April 23, 2017, stating that he/she sold 32GB mBicroSDHC in the Internet NAV and the Korean car page, and that he/she sold 3,000 won per unit.
