A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date of the final judgment.

2. 피고인은 2018. 1. 25. 15:00~16:00경 익산시 F 피고인의 주거지 안방에서 처 D과 피해자와 함께 술을 마시던 중, 피해자가 담배를 피우기 위해 위 주거지 작은방으로 들어가자 피해자를 따라 들어가서 갑자기 피해자의 옷 속으로 손을 집어넣어 피해자의 가슴을 주물러 만지고, 이에 피해자가 “왜 그러냐”라고 말하면서 피고인의 손을 쳐내면서 거부하자, 피해자에게 “가만히 있어!”라고 말하면서 계속하여 손으로 피해자의 젖꼭지를 비틀어 만지는 등 피해자를 강제로 추행하였다.

3.
