A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2012. 6. 16. 04:50경 청주시 흥덕구 C에 있는 D 찜질방에서, 피해자 E(여, 16세)가 잠을 자고 있어 항거불능의 상태에 있는 틈을 타 손가락으로 피해자의 오른 쪽 젖꼭지를 돌리면서 만져 청소년인 피해자를 추행하였다.

1. 주장의 요지 피고인은 피고인의 누나가 일하고 있는 이 사건 찜질방에 가서 잠을 자던 중 옆자리에서 자고 있던 남성이 심하게 코를 곯아 잠을 깨게 되었고, 조용하고 어두운 방을 찾아 잠자리를 옮기게 되었는데 잠을 자다가 잠결에 잠을 자고 있던 피해자의 가슴을 만지게 된 것에 불과하고, 피해자를 추행할 의사가 없었다.
