A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. Around October 2009, the Defendant: (a) received a request from C to allow C to obtain a loan as security on the land, etc. of Incheon Strengthening-gun; (b) then, the Defendant intended to help C to obtain a loan of KRW 5 million on his/her own at the request of C to obtain a loan on his/her own; and (c) C consented thereto.

Accordingly, around October 16, 2009, the Defendant requested E to grant a loan, and caused C to obtain a loan of KRW 100,000,000,000 from C at the point of Songhae-gu, Incheon, the Incheon, the Song Sea Office, the Songhae-gun, the office of the Incheon, as collateral for the above D land, etc., and received five million won from C at that place

As a result, the Defendant received KRW 5 million from C on the intermediation of matters belonging to the duties of officers and employees of financial companies, etc.

Accordingly, on November 10, 2009, the Defendant requested for a loan to E, and caused C to obtain a loan of KRW 350 million to secure the above F land, etc. at the point of Song Sea branch located in Incheon, Incheon, Incheon, the Song-gun, and around November 11, 2009, the Defendant sought KRW 35 million from H architect office located in Incheon, Incheon, Incheon, at the request of the Defendant.

As a result, the Defendant received KRW 35 million from C on the intermediation of matters belonging to the duties of executive officers and employees of financial companies.
