Purport of claim and appeal

[Claim]

1. Comprehensively taking account of the following facts acknowledged as to the cause of the claim, the Defendant is obligated to pay to the Plaintiff damages for delay calculated by the rate of 15% per annum, which is within the scope of the agreed interest rate, from November 3, 2015 to the day of full payment, on the record that the Plaintiff is the day following the delivery of the original copy of the instant payment order, as sought by the Plaintiff.

On September 15, 2010, the Plaintiff lent KRW 4,900,000 to B at an annual interest rate of 43.9%, and the Defendant jointly and severally guaranteed the loan obligations under B.

(b) the current balance of the principal of the loan is KRW 4,874,793;

[Ground of recognition] The facts without dispute, Gap evidence Nos. 1 through 3 (the defendant alleged to the effect that Gap evidence No. 3 was forged, but the defendant's argument is without merit since the writing, shape, etc. is considerably similar to the defendant's written statement, the same date, the same document of objection as that of November 13, 2015 prepared and submitted by the defendant, the receipt (written) of March 27, 2016, the signature of the preparatory document as of June 21, 2016 and the signature of Gap evidence No. 3 (joint guarantee contract) are compared to the defendant's written statement, and the purport of the whole pleadings as a whole.

2. As such, the plaintiff's claim should be accepted for the reasons, and the judgment of the court of first instance is just for the conclusion, and the defendant's appeal is dismissed.
