All of the prosecutions of this case are dismissed.
Reasons
1. The summary of the facts charged is that the Defendant, as the representative of (State) D in Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-do, is an employer who operates a manufacturing business of free production facilities using 25 full-time workers.
When a worker retires, an employer in violation of the Labor Standards Act shall pay wages, compensations, and other money and valuables within 14 days from the date of the occurrence of the cause for such payment.
Nevertheless, the Defendant, at the foregoing place of business, worked from April 1, 2013 to December 31, 2013, and did not pay the total of KRW 17,220,540 of the wages from July 1, 2013 to October 10 of the retired workers E, as well as the total of KRW 228,38,182 of the wages of the retired workers nine, as shown in the separate crime list, within 14 days from the date of retirement, without any agreement between the parties on the extension of the due date.
(b) An employer who violates the Guarantee of Workers' Retirement Benefits Act shall pay a retirement allowance within 14 days from the date of retirement where a worker retires;
Nevertheless, the Defendant worked in the foregoing workplace from April 25, 201 to May 16, 2014, and worked in the workplace from July 1, 2013 to July 31, 2014, and did not pay KRW 7,475,132, as well as KRW 4,864,485,132, within 14 days from the date of the retirement without agreement between the parties to the extension of the due date for payment.
The defendant of "2014 Highest 1799" is a person who conducts semiconductor equipment manufacturing business with ten full-time workers, who is a (ju) D representative director in C at the time of the receipt of the Chungcheongnam-Naman City.
When a worker retires, the employer shall pay wages, compensations, and other money and valuables within 14 days from the date when the cause for such payment occurred.
Nevertheless, the Defendant, at the foregoing workplace, served as the head of the department from August 26, 2013 to December 31, 2013, and retired from his/her office, was partly 2,426,250 won of the H’s wages.
