A defendant shall be punished by imprisonment with prison labor for four months.

Punishment of the crime

On October 14, 2015, the Defendant was sentenced to a suspended sentence of ten-month imprisonment with prison labor at the Gwangju District Court for fraud, and on October 22, 2015, the said judgment became final and conclusive and is still under suspended execution.

However, in fact, the defendant was thought to use the money that he received from the victim to pay his personal debts, and there was no particular property or fixed income, and even if he borrowed money from the victim, he did not have the intention or ability to pay it.

On November 18, 2014, the Defendant, by deceiving the victim as such, received from the victim the remittance of KRW 9 million from the F community credit cooperatives account in the name of F community credit cooperatives used by the Defendant to the borrowed money, etc., from January 13, 2015, through a total of four times as shown in the list of crimes, and acquired the money by defrauding the victim.

On January 30, 2015, the Defendant, under the pretext of an investment deposit, proposed that the Defendant will take over the sales slips from the aforementioned “D” main points to the victim E, while displaying the sales slips from the “D” main points. However, the Defendant refused to take over the sales slips from the victim. However, the Defendant again refused the payment amounting to KRW 50 million.
