The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal is unreasonable as the punishment (ten months of imprisonment, two years of suspended execution, and one hundred and sixty hours of community service) of the original judgment is too unfunied.

2. The judgment of the court below is reasonable in full view of various sentencing factors indicated in the instant case, such as the Defendant’s age, character and conduct, occupation and environment, background and result of the crime, and circumstances after the crime, etc.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
