1. All of the plaintiff's claims are dismissed.

1. Basic facts

A. On June 30, 1965, G completed the registration of transfer of ownership with respect to E, 1039 square meters (hereinafter “H”), and the Plaintiff completed the registration of transfer of ownership with respect to F, 1396 square meters (hereinafter “I”) prior to F, September 25, 2006.

B. On February 23, 1998, J, one of its wife, died on May 22, 2012, and the Defendants, one’s children, jointly inherited H one-third shares.

The plaintiff's assertion and its determination are the cause of the claim in this case, and the plaintiff agreed to exchange each other's land with the plaintiff, which was located in the farm house in H on May 8, 1970 among the management of his own graves installed on the ground of G, and the plaintiff who jointly acquired one-third shares of H by inheritance from G and J, the defendants who jointly acquired one-third shares of H due to inheritance are obligated to perform the procedure for the registration of ownership transfer for each one-third share of H and one-third shares due to the above exchange, and to accept from the plaintiff the procedure for the registration of ownership transfer for each one-third share of H as to each one-third share of H.

살피건대 갑 제4호증의 4, 5, 갑 제6호증의 1 내지 3, 갑 제7호증의 1, 2, 갑 제8호증의 1, 2, 갑 제9호증의 1의 각 기재 또는 영상에 의하면, I의 지상에 G 조부(祖父)와 부(父), 그리고 본인(本人)의 각 분묘가 설치되어 있는 사실은 인정되나, 위 인정사실만으로는 G이 1970. 5. 8. 원고와 H와 I를 서로 교환하기로 약정하였음을 인정하기에 부족하고, 달리 이를 인정할 만한 증거가 없으므로, 원고의 위 주장은 이유 없다.
