Reasons
Punishment of the crime
[criminal record] On October 15, 2015, the defendant was sentenced to a suspended sentence of three years for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Daegu High Court, etc. on the 23th day of the same month. On November 20, 2015, the defendant was sentenced to a suspended sentence of two years for a one-year imprisonment with prison labor for an injury at the Daegu District Court, which became final and conclusive on the 28th day of the same month.
[Criminal facts] The Defendant is the actual representative of C in Daegu Nam-gu, and is an employer who runs a construction business (human test) using nine full-time workers.
When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.
Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.
1. The Defendant did not pay KRW 10,00,00 for wages in September 1, 2014, when he/she retired on October 4, 2014, the amount of KRW 1,00,00,00 for the salary in October 9, 2014, the amount of KRW 90,000 for the wage in October 4, 2014, the amount of KRW 540,00 for G that retired on October 1, 2014, and KRW 10,00 for the wage in September 20, 2014, and KRW 10,000 for the wage in February 9, 205, the amount of KRW 950,00 for the wage in March 20, 200, the amount of KRW 20,000 for the wage in March 20, and the amount of KRW 10,005 for retirement within the agreed date.
2. The Defendant: (a) paid KRW 1,80,00 in February 2015, which was retired from his/her service under the jurisdiction of the said workplace from September 3, 2014 to April 14, 2015; (b) the monthly wage of KRW 1,80,000 in March; and (c) KRW 4,320,00 in April wage; and (d) the period from November 3, 2014 to April 17, 2015, the amount of KRW 1,250,00 in March 20, 2015 to KRW 1,875,00 in April wage of KRW 625,00 in employment; and (d) the amount of KRW 1,875,00 in March wage of KRW 7, 2014 to March 15, 2015 to April 31, 2015, respectively.
