Defendant shall be punished by a fine of two million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

1. Around September 30, 2019, the Defendant violated the Punishment of Minor Offenses Act: (a) left in front of the Michuhol-gu Incheon building B in a large sound, such as “I am fly fly fly, I am fly, I am fly, I am fly, I am a superior.”

2. Around September 30, 2019, around 02:55, the Defendant, such as public documents, was arrested from the street of Michuhol-gu Incheon Metropolitan City, as a flagrant offender, to the D District Guard E, and three other parties, from the D District Guard E, Incheon Michuhol Police Station, due to the suspicion under paragraph (1), and was transferred to the D District E located in the Michuhol-gu Incheon Metropolitan City on the same day.

The defendant had a physical certificate, which is a public document prepared by the security guards E in the above temporary border, and caused damage to the tear by hand.

Summary of Evidence

1. Application of the Acts and subordinate statutes on the notification of reported cases to the defendant's legal statement E accompanied by the police statement document (damage to physical certificate) 112;

Relevant provisions of the Act on the Punishment of Minor Offenses, Article 3(1)21 of the Punishment of Minor Offenses Act (a point of nearby disturbance), Article 141(1) (a) of the Criminal Act (a point of invalidity of documents for public use) and the choice of fines, respectively, for the crimes;

1. Article 70(1) and Article 69(2) of the Criminal Act to attract a workhouse;

1. The circumstances favorable to the sentencing of Article 334(1) of the Criminal Procedure Act with regard to the order of provisional payment: The Defendant recognized and reflected the instant crime.

Unfavorable circumstances: The defendant was unable to have a disturbance due to a large sound in the new wall house, and caused damage to the public documents at will while being investigated by the police officer dispatched.

Defendant has been punished several times for violence-related crimes.

In addition to the various circumstances against the above defendant, the defendant's age, sex, environment, motive, means and consequence of the crime, and all the sentencing conditions specified in the records and arguments of this case, such as the circumstances after the crime, shall be determined as ordered by the decision.
