A Imprisonment with prison labor for a year and two months, and for a defendant B, for eight months, respectively.
However, for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Defendant A
(a) No person, other than a marina society, shall commit any act similar to the riding voting, in connection with a racing conducted by the marina society, to provide goods or financial benefits to the winners of the racing;
From November 1, 2014 to July 2, 2016, the Defendant: (a) from the Defendant’s house of 103 Dong-si, Kimpo-si, Kimpo-si, 708 Dong-si, 102 Dong-si, 602 Dong-si, 602 Dong-si, Kimpo-si; (b) from the Defendant’s house of 103 Dong-si, 702 Dong-si, Kimpo-si, 602 Dong-si, Kimpo-si; (c) was granted a manager ID and password of the private horse site (F, etc.) operated by a person who is not his name by using a computer; and (d) was transferred from the users to the Defendant’s new bank account in the name of the Defendant and the Defendant’s mother H’s No. Hapo-si account in the name of the Defendant’s mother; (d) paid the amount of money corresponding to the remittance to the users; and (e) was paid the dividend from multiple users;
As a result, the defendant, in collusion with his name-free persons, committed an act similar to the riding voting in relation to the racing conducted by marina society, thereby paying property to the winners of the racing.
B. From July 1, 2016 to July 2, 2016, the Defendant visited at the house of Kimpo-si, 102 Dong 602 and Dong 602, and at the private horse site (J), and bling out a total of KRW 2,847,00 in betting and gambling conducted by a marina society.
2. Defendant B
A. The Defendant provided the Defendant’s house and computer to A in order to assist the Defendant’s act of paying property to the enemy by causing A, at the time, at the place specified in paragraph 1(a), and at the same time and place as specified in paragraph 1(a) and by allowing A to do any act similar to the horse riding voting. The Defendant’s home and computer are the mobile phone text messages with the change of site address, manager ID and password.
