【Criminal Facts】

From February 14, 2008 to June 13, 2012, the Defendants jointly operated the debt collection company called I Co., Ltd. (hereinafter “BJ”) from 702 of the H building in Busan-gu H building, and Defendant B and D from September 3, 2012 to May 2013, 2012, the Defendants jointly operated the debt collection company of L Co., Ltd from the second floor of the building in the Gyeongnam-si, Kimnam-si.

After the Defendants acquired a claim whose execution of rights is unclear due to the lapse of the extinctive prescription, etc., they conspired to engage in the business of collecting claims through demanding performance, requesting a payment order, requesting a seizure and collection order against multiple debtors.

On February 20, 2008, the Defendants acquired the claim for the payment of the Samsung Card in the amount of KRW 113,031,40 at a discount of 99% below the face value at the N Office of Daegu Northern Building 305, and executed the rights by means of civil action, such as Internet electronic payment order, bond seizure and collection order.

In addition, from February 14, 2008 to June 13, 2012, Defendant A and C acquired KRW 367,587,40,00 from February 14, 2008 to May 2013, 201 by transfer of all the claims of KRW 5,744, total face value of KRW 38,589,157,087 from February 14, 2008 to May 2013, through litigation, etc.

As a result, the Defendants conspired to acquire another person's right or pretended to acquire another person's right to exercise the right by means of litigation, etc.
