Defendant shall be punished by a fine of KRW 5,000,000.

If the defendant does not pay the above fine, 50,000 won shall be paid.

Punishment of the crime

[2013 fixed-term 2417] The Defendant is the representative director of the Gangnam-gu Seoul Metropolitan Government Bank to operate real estate sales business using 30 full-time workers.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days from the time when the cause for such payment occurred, but the defendant from the date of January 1, 2012 to the same year.

2. 1. The employer did not pay KRW 890,322 on January 1, 2012 to retired workers D, and did not pay KRW 24,244,596 in total amount of money and valuables to 13 retired workers within 14 days from each retirement date without any agreement between the parties on the extension of payment due date, as shown in the separate list of crimes committed against 13 retired workers.

(4) The Defendant, as the representative director of the company, is an employer who runs real estate sales business by making use of 30 full-time workers as the representative director of the company in question (see, e.g., Supreme Court Decision 2013Da2815, Apr. 2, 2015).

When a worker dies or retires, the employer shall pay the wages, compensations, and other money and valuables within 14 days from the time when the cause for such payment occurred, but the Defendant did not pay KRW 2,373,748, the sum of the wages of 580,645, wage of 200,000, wage of 1,000, wage of 200,000, wage of 793,103,748, from the date of retirement within 14 days from the date of retirement without any agreement between the parties on the extension of the payment period.
