Punishment of the crime
[2] The telephone financial fraud organization established a domestic or foreign call center in order to commit the act of fraud, fraud, etc. on loan terms and conditions, and shared roles by collecting personal information from others and misrepresenting them to the prosecutor's office, police and financial institutions, and making false statements in the name of the lending company, etc. for children hijacking, leakage of personal information, loan, etc., and then remitting money from victims to the large passbook recruited by the victims. Upon the transfer of money, the organization that made the withdrawal of the money to cause enormous damage to the victims; the call center that instructed the solicitation and withdrawal of the large passbook; the call center that instructed the victims to collect and withdraw the passbook; the management of the large passbook recruitment and withdrawal book; the management book that manages the large passbook recruitment and withdrawal book; the large passbook sales book; the delivery book of the large passbook; and the withdrawal book that withdraws the passbook deposited from the victim.
피고인은 동네 선배로 알고 지내던 B(2015고단1682 사건의 피고인)로부터 “내 지시에 따라 카드를 받은 뒤 돈을 출금해 달라”는 권유를 받고 전화금융사기 조직에 가입한 ‘인출책’으로, 성명불상의 콜센터 직원 및 위쳇(중국 채팅 프로그램) 채팅명이 ‘D’, 'E', 'F‘ 등과 함께 다른 성명불상의 조직원들이 국내 통장거래자에게 전화를 걸어 농협직원이나 경찰, 검사를 사칭하며 계좌가 도용되었다는 등의 거짓말을 하여 소위 대포통장으로 입금하게 되면, 성명불상의 조직원들로부터 소위 대포통장의 현금카드와 통장을 전달받아 입금된 돈을 인출하기로 공모하였다.
