1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. On February 9, 2012, the Plaintiff’s assertion: (a) at a branch office of the Korea Post affiliated with Defendant Korea Post, each opened an account with a maturity of one year (Account No. B; hereinafter “first account”) and an annual account with a maturity of six months (Account No. C; hereinafter “Second Account”); (b) deposited KRW 1.5 million in each of the above accounts on the same day; and (c) did not cancel the entry of the first account.
However, since the branch office refuses to return the deposit of the first account on the ground of the cancellation of the Plaintiff’s opening of the first account, the Defendant is obligated to pay to the Plaintiff KRW 15 million and interest or delay damages on the first account deposited by the Plaintiff.
2. Determination
A. 1) On January 19, 2010, the Plaintiff opened a 100 million won (Account Number D) at the post office of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a branch of a bank. On January 19, 201, the Plaintiff opened the said bank account at the 104,39,200 won (Account Number E) and deposited the said account at the 14,400,000 won in total with 80,000 won at the 14,000,000 won (hereinafter referred to as the above bank account at the 14:0,000 won on February 14, 2012, the Plaintiff opened the alternative account at the 1601,006,0000.
3) On August 9, 2012, the Plaintiff deposited the second account with a maturity of 2040 on the same day at the branch office of the branch office of the branch office of the branch office of the branch office of the branch office in lieu of KRW 15 million out of the cancellation amount of KRW 106,683,150, out of the cancellation amount due to the settlement of maturity of 106,683,150.
