A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dsch Rexton) is a person engaging in driving a motor vehicle.

On February 22, 2014, the Defendant driven the said car on February 7, 2014, and led to a road of five lanes in front of the running distance of the political party located in 642 as the Seo-gu Incheon, Seo-gu, Incheon, along two lanes from the north Korean History to the driving distance of the city at about 40km in speed.

At the time, the passenger car driven by the victim E (the age of 63) who was driving in the same direction was stopped in the air traffic signal, so the person engaged in driving of the vehicle was obliged to pay a duty of care to drive the vehicle without drinking the driver's license.

Nevertheless, the Defendant neglected to do so and found that the above damaged vehicle was at latest stopped into the signal atmosphere of the Defendant’s vehicle without securing safety distance in a situation where it is difficult to drive under normal conditions, such as 0.163% of alcohol by drinking alcohol while under the influence of alcohol without obtaining a driver’s license, and 0.163% of alcohol level, and then received a driver after driving the damaged vehicle on the left side of the driver’s vehicle.

Ultimately, the Defendant driven the said car in a situation where normal driving is difficult due to the influence of alcohol or drugs as above, and suffered injury to the victim, such as catitis, which requires approximately two weeks of medical treatment.

2. Violation of the Road Traffic Act and the Road Traffic Act (Non-licensed driving) are under the influence of alcohol with a blood alcohol concentration of about 0.163% without obtaining a driving license from a vehicle driving license within approximately 300 meters prior to the discharge from the sea area in Seo-gu Incheon, Seo-gu, Incheon to the point of the above accident.
