All appeals filed by the defendant and prosecutor are dismissed.

Reasons

1. Summary of grounds for appeal;

가. 피고인 ⑴ 사실오인 내지 법리오해 ㈎ 피고인은 근로자 C에게 2014. 12.과 2015. 1.의 각 임금을 모두 지급하고, 퇴직 후에는 별도로 500만 원을 지급하였는바, 이로써 근로자 C에 대한 미지급 임금과 퇴직금의 대부분이 변제되었다.

(다만, 피고인은 정확한 금액을 파악하기는 어려우나, 그 이전의 근무기간 동안에 근로자들에 대하여 간헐적으로 어느 정도의 임금을 지급하지 못하였고, 퇴직 후에는 퇴직금을 지급하지 못하였을 뿐이다). ㈏ 이 사건 공소사실 기재 미지급 임금 및 퇴직금은, 근로자 C, D가 피고인과 함께 주식회사 G(이하 ‘G’이라고 한다)에 합류한 후에 지급받지 못한 것으로서, 이에 대하여 피고인이 사용자로서 책임을 부담하지 아니한다.

2. Determination:

A. In full view of the following facts and circumstances acknowledged by the first instance court’s duly admitted and investigated evidence regarding the Defendant’s assertion of mistake of facts or misapprehension of the legal doctrine regarding the amount of unpaid wages and retirement allowances, the Defendant’s unpaid wages are KRW 3,66,680 in total, and retirement allowances are KRW 6,00 in total, as stated in the judgment of the first instance court, as well as KRW 3,666,680 in total, on December 2014 and January 2015.
