The defendant's appeal is dismissed.

The summary of the grounds for appeal (unfair sentencing) of the lower court's punishment (one hundred months of imprisonment) is too unreasonable.

Judgment

Although the defendant is in conflict with the confession of the crime, and the court below made a full repayment of the amount obtained through deception and agreed with the victim, the defendant's assertion is without merit, in full view of the following circumstances: (a) the defendant committed the crime of this case again in the same kind of crime within a half-year period after having been sentenced to imprisonment with prison labor due to fraud; (b) the punishment of the same crime has been completed; (c) the sentence of the court below is within the scope of sentence recommended on the sentencing guidelines; and (d) other various circumstances that form the condition of sentencing as specified in the records and arguments, the sentence of the court below is too unreasonable. Therefore, the defendant's assertion is without merit.

Therefore, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is without merit. It is so decided as per Disposition.
