Reasons

1. Facts of recognition;

A. On September 20, 2010, the Plaintiff, a corporation operating a building management business, entered into a building management contract (hereinafter “the instant management contract”) with the Yeonsu-gu Incheon Metropolitan City E main complex building (hereinafter “instant building”) with a limited liability company for the development of Songdo International City (hereinafter “Songdo International City Development”), and according to the management contract and the management rules enacted based on the standard rules in accordance with Articles 9-3 and 28 of the Act on the Ownership and Management of Condominium Buildings and other relevant Acts and subordinate statutes (hereinafter “the instant management rules”), and collected management fees from sectional owners and occupants of the instant building with the delegation of the said company.

B. On November 9, 2012, Songdo International City Development concluded a lease contract with F to KRW 100,000,000 on the instant building E-dong 234 through 238 (hereinafter “instant real estate”); from November 21, 2012 to July 31, 2016; from February 10, 2013 to February 9, 2014; from February 10, 2014 to February 9, 2015, to lease the instant real estate with the term “from February 1, 2015 to February 1, 300,000,000 won; from February 10, 2015 to February 9, 2016; and from February 16, 2016 to July 16, 2016.”

C. As to subparagraph 236, 237, and 238 of the instant real estate on April 8, 2013, Defendant (Appointed Party) and Defendant (Appointed Party) and Selected Party D entered into a contract for supply of E-commercial facilities (hereinafter “instant supply contract”) between the development of Songdo International City on June 14, 2013 and each of the instant real estate on June 234 and 235, and the registration of ownership transfer is completed in the name of each buyer on June 25, 2013 with respect to subparagraphs 236, 237, 238, and 235.

The exclusive use and common use of the entire real estate of this case.
