1. 모욕 피고인은 2012. 8. 30. 23:10경 고양시 덕양구 C건물 302동 현관 입구에서 술 취한 사람이 쓰러져 있다는 112신고를 받고 출동한 고양경찰서 D지구대 소속 경사 E와 순경 F이 피고인에게 신분증 제시를 요구하자 경비원 G과 주민들 약 10여명이 지켜보는 가운데 수첩을 꺼내 보이며 “나 검사야, 니 이름 뭐야, 씨발놈들아”, “이리 와봐, 니 이름 뭐야, 무전기 줘봐, 너의 지휘권이 누구에게 있어”, “너에게 무슨 체포권이 있어, 구인권이 있어, 좆까지 마, 새끼야”라고 말하여 공연히 피해자들을 모욕하였다.

2. 공무집행방해 피고인은 제1항 기재 일시, 장소에서 피고인은 폭행 현행범인으로 체포하고 순찰차 H 차량에 태우려고 하자 자신을 체포한다는 이유로 고양경찰서 D지구대 소속 순경 F의 낭심과 오른쪽 정강이를 수회 오른쪽 발로 걷어차고, 경사 E의 왼쪽 정강이를 오른쪽 발뒤꿈치로 수회 걷어찼다.

Accordingly, the defendant interfered with the legitimate execution of duties by police officers on the control of crimes.
