Summary of Grounds for Appeal

The sentence of the court below (one year of a suspended sentence in six months of imprisonment) is too unhued and unfair.

Judgment

It is not good that the defendant has repeatedly inflicted bodily injury while disputing the victim who is the spouse, and that the victim is trying to punish the defendant is disadvantageous.

However, the defendant's mistake is recognized, and there is no previous conviction or fine exceeding the same criminal record or fine. In full view of the circumstances of the crime of this case, circumstances after the crime of this case, the defendant's age, character and conduct, and environment, etc., the prosecutor's assertion is without merit, since the court below's punishment is too unreasonable.

Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition.
