Defendant shall be punished by a fine of three million won.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

No person shall transfer a password, a user number registered with a financial institution or an electronic financial institution, etc. necessary for the use of a cash card or cash card which is the means of access of an electronic financial transaction.

Nevertheless, around 09:30 on October 30, 2019, the Defendant: (a) sent a e-mail card to KRW 10 million; (b) opened a loan with the e-mail transaction performance on the e-mail; and (c) opened a copy of the e-mail card linked to the e-mail account in the name of the Defendant to the sender of the name in front of Yangcheon-gu Seoul Metropolitan Government, on October 30, 2019.

Accordingly, the Defendant transferred one copy of the physical card, which is an electronic financial transaction means, to another person.
