A shall be punished by imprisonment with prison labor for four months and by imprisonment for six months.

Punishment of the crime

Defendant

A is a person who served as the president of the Busan Style-gu Ethyle-gu council from March 1, 2008 to March 31, 201, and Defendant B is a person who served as the director of the above Style-gu Office from November 2007 to March 31, 201.

1. Defendant B

A. On May 29, 2008, the Defendant embezzled 840,000 won deposit money of KRW 10,00 by arbitrarily using the deposit money of KRW 840,00 from the above date to March 28, 201, in total 21 times, as shown in the attached Table of Crimes (1), while obtaining KRW 40,000 deposit money from the F, which had been newly occupied in the above last session, and kept for the said victims, on behalf of the said victims.

B. Around June 2008, the Defendant embezzled the charges for the use of an external parking lot by using the same method 5,390,000 won in total 33 times from the above date to March 2011, as shown in the attached Table of Crimes (2), while he received KRW 70,00 from the person who was not the above-mentioned person but was not the owner of the prefection restaurant using the above parking lot, and received KRW 70,000 from the person who was not the owner of the prefection restaurant using the above parking lot, and was in the course of performing his duties for the above victim’s residents.

C. On August 8, 2008, the Defendant, at the above management office, withdrawn 450,000 won from the above account and arbitrarily used it for personal purposes while keeping the management expenses deposited in the agricultural bank account under the name of G for the said occupant. From the above date to May 13, 2009, the Defendant additionally withdrawn the management expenses equivalent to KRW 716,970 in total six times from the above six times, such as the list of crimes (3) Nos. 2 and 7.
