Punishment of the crime

C was a person who served as the representative director of D Co., Ltd. (hereinafter referred to as “D”) from around December 2, 2009 to August 28, 201, and E was a person who was in charge of overall company management, such as accounting and branch management, by holding the position of director at the head office of the above company, as he was in charge of accounting and branch management. The above C and E, etc. provided business owners with workplace skill development training services by means of Internet remote training at D offices located on the third floor of the Seo-gu in Gwangju-gu, Gwangju-gu, for business owners who provided workplace skill development training with part of the educational expenses as the employment insurance fund.

In this regard, the amount of subsidies granted from the Employment Insurance Fund to employers in comparison with the above expenses for workplace skill development training was partially limited, and the employer did not want to receive “workplace skill development training” by bearing expenses, and the employees did not want to receive training by accessing the Internet during working hours.

The above C and E, etc., in collusion with employers to conduct workplace skill development training in the way of the above "Internet Tele-Training", can obtain higher points in the part of education and training for employees, thereby having good results in external evaluation of enterprises, and the Ministry of Labor received full amount of education expenses in the Ministry of Labor.

However, since only the amount of future support from the Ministry of Labor is received from D as educational expenses, it was argued that there is no cost actually borne by employers.

The above C, E, etc. shall receive subsidies from the Republic of Korea (Employment Ministry of Labor) from the damaged person, ① send educational expenses to the business owner first and then deposit them into D's account again.
