Basic Facts
The Plaintiff is the owner of the Eel (hereinafter “instant building”) who is a building of 181.8 square meters and its 7th floor above the land in Changwon-si, Changwon-si.
Defendant Manduk Construction Co., Ltd. (hereinafter “Defendant Co., Ltd.”) is a company that executed the projects for improving G water-related wetlands (hereinafter “instant construction projects”) by contract with Defendant Changwon-si to remove J market (AD) and concrete removal works on the surface of dudu river (hereinafter “previous construction”) conducted in the vicinity of the instant building from Defendant Changwon-si.
In 2010 and around 201, J market and J market removal works were implemented. The separation distance between J market and the building of this case is less than 8 meters, while the removal of concrete on the duct river was implemented around early 2012, but the removal works was also conducted on G duct roads located immediately adjacent to the building of this case.
The instant construction was implemented to improve the stability of the existing retaining wall of G members located in Mhap-gu Hdong. On July 2, 2012, the instant construction was implemented as “H-Ptile Saturdays” in order to maintain the stability of the existing retaining wall and to remove reinforced concrete structures in the foundation, and completed construction on June 21, 2014.
