The defendant shall be innocent.
Reasons
1. Any person who intends to take out or bring in goods, etc. prosecuted in North Korea shall obtain approval from the Minister of Unification regarding the items, forms of transactions, methods of taking out, etc., as prescribed by Presidential Decree;
The defendant is written indictment around October 2012 without obtaining approval from the Minister of Unification, and around June 2012, the indictment is written by the defendant.

2. Determination
A. According to Articles 27(1)3 and 13(1) of the Inter-Korean Exchange and Cooperation Act (hereinafter “the Act”), a person who intends to take out or bring in goods, etc. under Article 13(1) of the Act shall obtain approval of the Minister of Unification with respect to the item, type of transaction, method of payment, etc. of the goods, etc. as prescribed by Presidential Decree, and Article 27(1)3 of the former Act (wholly amended by Act No. 12396, Mar. 11, 2014) provides that a person who takes out or brings in goods, etc. without obtaining approval under Article 13(1) of the Act shall be punished by imprisonment for not more than three years or by a fine not exceeding 10 million won.
B. However, the term “taking out or bringing in” refers to the movement of goods between South and North Korea simply via a third country for the purpose of sale, exchange, lease, loan for use, donation, use, etc.
