A defendant shall be punished by imprisonment for four months.
Reasons
Punishment of the crime
1. Fraud;
A. On September 21, 2012, around 02:00, the Defendant pretended to pay the alcohol value to the victim D, operated by the victim D in Kimhae-si Kimhae-si, and ordered the said victim to provide alcohol and alcohol.
However, the defendant did not have the intention or ability to pay the drinking value.
Nevertheless, the Defendant, as such, by deceiving the above victim, was provided with alcohol and alcohol equivalent to the total market value of KRW 80,000,000 from the above victim.
B. On September 25, 2012, around 22:20 on September 25, 2012, the Defendant ordered the victim H, who is an employee of the said main store, to pay the alcohol value, as if he were to pay the alcohol value.
However, the defendant did not have the intention or ability to pay the drinking value.
Nevertheless, the Defendant deceiving the above victim and was provided by the above victim with alcohol and alcohol equivalent to the total market value of KRW 300,000,000.
C. On September 26, 2012, around 03:50 on September 26, 2012, the Defendant ordered food to the “J” restaurant No. 101 in the Kimhae-si, the Defendant, as if he were to pay food to the Victim K, who is an employee.
However, the defendant did not have the intention or ability to pay food values.
Nevertheless, the Defendant, by deceiving the above victim, was provided with alcohol and skill equivalent to 17,000 won in total at the market price from the above victim.
2. Interference with business;
A. The Defendant: (a) from around 00:30 on September 26, 2012 to around 01:00 on the same day, at “G musical stores” located in F in Kimhae-si to KRW 1:00 on the same day, and (b) on the same day.
When the victim H, who was an employee of the above main point, was requested to pay the alcohol value because he did not pay the alcohol as stated in paragraph (1), the above victim is not deemed to be "....... the police shall not be calculated..... the funeral will not be held in Han-do...."
