A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant is a person who operates a precious metal sales store under the trade name of "D" in Jongno-gu Seoul Metropolitan Government C commercial building 24.

No one shall use any trademark identical with or similar to another person's registered trademark on goods identical with or similar to the designated goods, and deliver, sell, forge, imitate, or possess such trademark for the purpose of using or making another person use it.

피고 인은 위 귀금속 판매점에서, 2015. 1. 12. 경 샤넬이 대한민국 특허청에 등록한 샤넬 상표( 제 0304800호) 와 동일하거나 유사한 상표가 부착된 위조 샤넬 금 팔찌 1점( 진정상품 가액 300만 원 상당) 을 E(2015. 8. 3. 구속기소 )로부터 구입한 것을 비롯하여 그 때부터 2015. 7. 8. 경까지 별지 범죄 일람표 (D, A) 기 재와 같이 총 36회에 걸쳐 위 E로부터 위조 귀금속 39점( 진정상품 가액 1억 5,360만 원) 을 구입하여 그 무렵 성명 불상의 손님들에게 판매할 목적으로 소지함으로써 샤넬 등의 상표권을 침해하였다.
