1. On December 5, 2014, the National Labor Relations Commission: (a) between the Plaintiff and the Defendant joining the Defendant on December 5, 2014.
Reasons
1. Details of the decision on retrial;
A. The Plaintiff is a corporation that employs 4,000 regular workers and runs a comprehensive construction business.
The Intervenor B (hereinafter referred to as the “ Intervenor B”) joined the Plaintiff Company on May 1, 1994 and served as the head of the global marketing headquarters, and the Intervenor C (hereinafter referred to as the “ Intervenor C”) joined the Plaintiff Company on June 12, 2006 and served as the head of the public service team belonging to the Civil Work Environment Headquarters.
B. On March 27, 2014, the Plaintiff: (a) held a personnel committee; (b) Company B traded money with D who is an interested party (hereinafter “Disciplinary Reason 1”); (c) distributed false facts or non-verifications related to the Plaintiff; and (d) commenced on the Internet car page opened by the Plaintiff’s specific department and management through the intra-company Messengers; and (c) copied audit data without permission to use them for personal purposes (hereinafter “Disciplinary Reason 2”); and (d) took an unfaith attitude in the audit process.
(hereinafter “Disciplinary Reason No. 4”) decided to be subject to disciplinary dismissal as a ground for disciplinary action, and notified the Intervenor B on April 4, 2014.
C. On February 28, 2014, the Plaintiff: (a) held a personnel committee and neglected to manage the password of the approval (hereinafter “Disciplinary Reason”) by the Intervenor C; (b) held the office of the head of the public service team and the head of the management team in Kim Jong-si E (hereinafter “Sim Construction”); and (c) entrusted the management of the seal of the head of the Tong and the company to D, who is an employee under the supervision of the head of the Tong and the company; (b) did not confirm the details of the deposit transaction; and (c) did not send it to D; and (d) did not send it to the financial management department attached with evidentiary documents; and (e) the lease deposit money returned after the completion of the lease by the on-site employees, to the account of the head office.
