피고인은 2016. 4. 26. 18:35경 고양시 덕양구 J에 있는 피해자 K이 운영하는 'L'에서 성명을 알 수 없는 종업원이 다른 손님이 구입한 물건 계산으로 주의가 소홀해진 틈을 타, 위 매장 진열대에 있는 피해자 소유의 시가 16,840원 상당의 한우등심 1팩, 시가 19,220원 상당의 한우등심 1팩, 시가 3,980원 상당의 삼겹살용 모듬쌈 1개, 시가 7,280원 상당의 종가집열무김치 1봉지, 시가 1,580원 상당의 부산어묵 1봉지 등 합계 48,900원 상당의 물건을 몰래 가지고 가 절취하였다.
