A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
The defendant, while operating the corporation C, purchased and sold the land D and E in Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-do, and developed a logistics complex, and invested funds necessary for the purchase of land and the development of a complex from F and G.
1. On May 26, 2008, the Defendant received 300 million won from the victim F office located in Seo-gu Daejeon, Seo-gu, Daejeon, for the logistics complex development project of D and E land in terms of land purchase deposit and related expenses, and kept the logistics complex development project, and used 100 million won as land purchase contract deposit and embezzled the remaining 200 million won for the purpose of performing the Defendant’s personal obligation at his own discretion.

The Defendant, at C, demanded a stock company to compensate for investment, such as design expenses incurred in relation to the said land, and from the O on March 5, 2010, KRW 550 million from the O on March 5, 2010.
