Reasons
Punishment of the crime
Around August 2008, the Defendant entered into a contract with the victim D Co., Ltd. on the general supply of solar housing, and agreed that the Defendant will bear all materials and construction liability except the defect in solar heat house itself.
1. Around February 26, 2010, the Defendant attempted to commit fraud, even though he had installed a solar heater supplied by the victim to his residence. However, as a continuous defect occurred at the solar heater of the above E, the Defendant was willing to receive the insurance money related to the defect by claiming the Seoul Guarantee Insurance Co., Ltd. with the content that the defect insurance certificate is attached to the contract with the victim.
On April 2012, the Defendant stated that “1,610,00 won” in the amount of the claim for insurance money from the office of the (i) GG office located in the Sinsan-dong, Yongsan-gu, Yongsan-gu, Busan-si, and (ii) that “the site was not a site due to the collection equipment and pipes transmission due to the flow of vertical water, (ii) the operation of the house and pipe waves, (iii) the unit of the unit of the Dong-dong, and (iv) the above E “the installation of the unit of the unit of the tank and the scheduled return of the amount of the insurance money to be recovered from the insurance money, and (iv) signed and sealed the written claim for the insurance money.”
However, as above, the Defendant agreed to be liable for all defects, such as materials and installation, except for inherent defects in the solar heatr itself, and the above defect was not a defect in the solar heatr itself, and thus did not fall under the requirements for claiming insurance proceeds.
Nevertheless, on April 26, 2012, the Defendant submitted to Seoul Guarantee Insurance Co., Ltd. a claim for the above insurance money, thereby deceiving the above Seoul Guarantee Insurance Co., Ltd., and its members sought KRW 1,610,000 insurance money from the above Seoul Guarantee Insurance Co., Ltd., but it is the wind to raise an objection by the victim.
