Punishment of the crime

Around July 5, 2012, the Defendant drafted a loan contract with the purport that “the Defendant would make an installment payment of KRW 1,242,413 on the 10th day of each month during the 36-month period from the date of lending KRW 40 million to the staff in charge of Hyundai Capital Co., Ltd. who is the victim, within the (ju) fire agency in Seoul Fire Prevention Dong 620-213, and to the staff in charge of Hyundai Capital Co., Ltd. who is the victim.”

However, since the defendant purchased a new car and thought that he would make a loan to a credit service provider, even if he received a loan from the victim company, he did not think that he would actually purchase and operate the vehicle, and since there was no other economic situation such as there was no revenue source at the time, there was no intention or ability to make the installment in time.

As such, the Defendant, by deceiving the victim company, was given KRW 40 million under the pretext of loans from the victim.
