피고인은 2013. 1. 6. 02:30경 김천시 B에 있는 ‘C’ 주점 앞길에서 피고인의 여자 친구 D과 피해자 E(22세)의 일행 F이 서로 쳐다보았다는 이유로 시비가 되어 다투는 것을 보고 있던 중 피해자가 다가오는 것을 보고 격분하여, 피고인은 피해자에게 “너, 나 누군지 알아, 새끼야”라며 피해자의 머리채를 잡아 흔들고 바닥에 넘어뜨려 피해자의 얼굴, 어깨, 엉덩이, 허벅지 부위를 발로 차고, 피고인의 일행인 G은 피해자의 얼굴을 발로 수회 찼다.
