The appeal is dismissed.

The grounds of appeal are examined.

For the reasons indicated in its reasoning, the lower court upheld the first instance judgment that acquitted the Defendant on the ground that there was no proof of crime regarding the facts charged in the instant case.

In light of the record, the lower court did not exhaust all necessary deliberations, as alleged in the grounds of appeal, and did not err by misapprehending the fact, or by misapprehending the legal doctrine on the criminal intent to acquire fraud, by failing to exhaust all necessary deliberations, and exceeding the bounds of the principle of logic and experience and by exceeding the bounds of the principle

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
