Defendant shall be punished by imprisonment for not less than two years and six months.

All of the applicants for compensation are dismissed.

Punishment of the crime

[2014 Highest 1475] The Defendant is a person who actually operates the “G” from the “G” in the Lighting-si.

On April 16, 2013, the Defendant, at the I depository located in Seo-gu, Incheon, Seo-gu, Incheon, sold, and embezzled, from December 2014 to January 2014, approximately KRW 114 tons of steel in the market price of the said steel bars, which is equivalent to KRW 82,689,624, among the said steel bars, at the I depository located in Seo-gu, Incheon, for approximately 269 tons.

[2014 Highest 2195] The Defendant is a person who actually operates the “G” from the “G” in the Lighting-si.

1. From May 23, 2013 to October 29, 2013, the Defendant: (a) stated, “If necessary, the Defendant would offer steel bars to the victim company; and (b) supplied the victim company from May 23, 2013 to October 20, 2013, the Hyundai Steel Co., Ltd., Ltd., located in Cheongyang-si, Chungcheongnam-do, Cheongyang-do, with the market value of 333,55,750 won in total, which is the victim company’s market value, to receive and keep the freight of 44.741 tons at the scene of the victim company LA, which is located in Cheongyang-do, Chungcheongnam-do, Chungcheongnam-do; and (c) supplied it to another construction site from around 14 March 23, 2013 to around 14 to around 14, 2013 by receiving the freight of 33,55,750 won in total, the victim company’s market value.

From that time to June 15, 2014, the Defendant arbitrarily consumed the steel bars equivalent to KRW 518,50,500, while receiving and keeping the steel bars equivalent to KRW 1,658,019,00 from 12 victims as shown in Appendix I.

Accordingly, the Defendant embezzled the victim company's property.

2. When the above G was closed down due to the default of national taxes, the Defendant, while trying to continue his business by leasing his business registration certificate from N, had the name and resident registration number indicated in the above business registration certificate changed to his own.

The defendant is a policeman on May 2014.
