1. The Defendant’s KRW 5,00,000 and the following day shall be 5% per annum from July 1, 2011 to August 31, 2017 to the Plaintiff.

1. Basic facts

A. The Plaintiff purchased 13,190 square meters of D forest land in Sung-gun prior to subdivision from C, and subsequently developed and divided the ownership transfer registration on the said land to a third party without completing the registration, and proceeds from C to complete the registration of ownership transfer on the land to be sold directly by the buyer.

B. Before the said subdivision, D forest was subject to registration conversion into E forest land 12,792 square meters on December 2, 2009, and the said E forest was divided into F forest land 1,094 square meters on December 4, 2009, G forest land 11,416 square meters, H forest land 142 square meters and 140 square meters on forest land.

C. On March 24, 2010, the Plaintiff agreed to receive KRW 30 million for down payment of KRW 30,000,000 on March 31, 2010 and KRW 14,416,000 for a specific amount of KRW 241 square meters (hereinafter “instant land”) among 11,416,00 square meters of forest land G in G prior to the said division (hereinafter “instant land”). In selling KRW 14,00,000 for a total of KRW 1,40,000 per square year, the Plaintiff agreed to be paid on April 30, 2010.

On April 9, 2010, G forest 11,416 square meters was divided into 300 square meters in J forest, 4,844 square meters in K forest, 296 square meters in L forest, 653 square meters in M forest, 473 square meters in N forest, 798 square meters in I forest, 297 square meters in O forest, 1,273 square meters in P forest, 2,482 square meters in G forest, etc.

E. On May 8, 2010, the Plaintiff agreed to pay 30,000,000 won to the Defendant up to June 31, 2011, when determining the purchase price of KRW 30,000,000 as LA forest (89 square meters, and the sales contract was written as “SIBD”; hereinafter “instant land”).
