A defendant shall be punished by imprisonment for four months.

Punishment of the crime

On September 5, 2019, the Defendant was sentenced to seven months of imprisonment for fraud at the Daejeon District Court, and the said judgment became final and conclusive on the 17th of the same month.

The Defendant had been operating a coffee store on the Seo-gu B 1st, Seo-gu, Daejeon, with the trade name “C” increased in debt, visited the convenience store that makes it difficult to operate the said coffee store, and was aware of the fact that he got a friendship to the victim D, who had been aware of the said coffee store, to obtain money by deceiving the victim D with the said coffee store as having been well as making profits as he did so.

Around July 3, 2015, the Defendant made a false statement to the victim “C” stating that “A shall pay monthly interest, and the principal shall also be repaid until May 13, 2016, as the average monthly income was at least KRW 500,000 and KRW 100,000,000,000,000,000,000,000,000,000 won was paid.”

However, the Defendant did not have any intention or ability to fully repay, even if he/she borrowed money from the victim, such as the amount of debt up to KRW 12,330,00,000, as the Defendant did not operate well.

The Defendant, from the victim on July 3, 2015, KRW 30 million around July 3, 2015, KRW 15 million around the 20th of the same month, and the same year.

8. A total of KRW 49.5 million, including KRW 4.5 million around 13.m., transferred to one bank account in the name of the Defendant (E).

Accordingly, the defendant was given property by deceiving the victim.
