A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

The Defendant, on April 2016, 2016, 1275, committed as if the Defendant could move into a rental apartment by using the friendships of the executives and employees of SH construction, with the intent to acquire money in the name of the deposit money for moving into a rental apartment by receiving the money from them.

On April 2016, the Defendant called with C, a branch of the Gangseo-gu Seoul Metropolitan City, which works in the agricultural products wholesale market, located in the Gangseo-gu Seoul Metropolitan City, on April 4, 2016, and let C, who is aware of the fact, deliver the above contents to E, victim F, victim G, victim H, victim I, victim J, victim J, victim J, victim J, and victim K, and victim K, by making use of his pro rata portion, to the effect that “I want to move in to the D rental apartment of the SH from July 2016.” In this context, the Defendant made it false statement to the effect that “I want to move to the rental apartment in the surrounding area. If there is a person wishing to move to the rental apartment, I would change the above contents.”

However, the defendant did not know and did not have any authority or ability to move into the above rental apartment even if he received money from the victims because he did not have any authority or ability to move into the above rental apartment.

As above, the Defendant, as from April 6, 2016 to May 12, 2016, by deceiving the victims, received approximately KRW 16 million in total as the deposit money for the rental apartment as shown in the attached Table 1 from around April 6, 2016 to around May 12, 2016, and acquired it by deceiving them.

The Defendant, on January 2016, 2016, took place as if the Defendant could have occupied a rental apartment by using friendly portion among executives of the Korea Land and Housing Corporation (LH). The Defendant, 2276, 201, is the money in the name of the contract deposit for the occupancy of the rental apartment.
