Defendant A, B, and E jointly and severally with the Plaintiff KRW 508,984,470 as well as its related amount from September 17, 2013 to September 2013.
Reasons
1. Basic facts
A. 1) On March 28, 2013, the Plaintiff entered into an insurance contract for performance guarantee (hereinafter “Defendant A”).
2) As between Defendant A and Defendant A, Inc., Ltd. (hereinafter referred to as “slunchn”)
(B) The performance guarantee insurance contract (hereinafter “instant performance guarantee insurance contract”) with the following contents that the Plaintiff is obligated to pay the insurance proceeds to the lot knife in the event of an insured incident due to a failure to perform the contractual obligation as set forth in [Attachment 1] as set forth in the following [Attachment 2].
(2) The instant performance guarantee insurance contract provides that the Defendant A and its guarantor shall immediately pay the insurance money when the Plaintiff paid the insurance money due to the failure of the Defendant A to pay the obligation guaranteed by the Plaintiff, but that, if delayed, the amount of the insurance money shall be paid in addition to the interest rate publicly notified by the Plaintiff from the day after the date of payment of the insurance money to the day of full payment.
On the other hand, with respect to the rate of delay compensation to be applied from January 1, 201, the Plaintiff determined 6% per annum from the date following the payment date of insurance money to 30 days, 9% per annum from the next day to 90 days, and 15% per annum from the next day to the public notice.
[Attachment 1] The details of the prime contract (unit: the prime contract) is the contract amount under the name of the securities number insured contract, Jsunkyman Co., Ltd. from January 1, 2013 to December 31, 2013. 1,00,000 [Attachment 2] Guarantee Insurance (unit: 1,000,000,000,000 as the date of guarantee of the insurance coverage period of the (unit) Securities Number Insured Co., Ltd. from January 1, 2013 to December 31, 2013, the credit guarantee contract was concluded between the Plaintiff and the Defendant B, D, and E with each of the Defendant’s respective debt guarantee contracts as between the Plaintiff and the Defendant B, and the Defendant B, and the Defendant A, respectively, on March 28, 2013.
