Defendant shall be punished by a fine of 1.5 million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

[2018 High 1185] The Defendant is an employer who runs a restaurant business in the trade name of “C cafeteria” in the Open-gu Seoul Metropolitan Government B.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred.

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

The Defendant did not pay the total amount of wages of 490,00 won in July 2017, 2017, wages of 2,300,000 won in August 2017, 2017, wages of 2,300,000 won in September 201, 2017, wages of 160,000 won in October 9, 2017, and wages of 160,000 won in May 9, 2017 to October 2, 2017, and of 160,545,000 won in employment from around July 201, 2017, wages of 2,50,500,000 won in total between the parties to retirement and 10,005,000 won in October 1, 205, 205, 2010.

The defendant of "2018 High 1680" is an employer who is a manager of the C cafeteria located in Young-gu, Young-si B and operates a restaurant business using four full-time workers.

(a) When a worker dies or retires, the employer shall pay the wages, compensations, and all other money or valuables within 14 days after the cause for such payment occurred;

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant did not pay KRW 1,50,000 of the retired F’s wages in November 2, 2017 from December 2, 2015 to November 23, 2017 at the above workplace within 14 days from the date of retirement where the cause of payment occurred without agreement between the parties on extension of the payment deadline.
